You do not have to speak about the cop in court. You do not need to say if you saw or not the police officer or the police car. It is not important. You are not a criminal. The criminals watch the police...

Obviously, information I give here is only if you protest a ticket for an infringement which you did not make and that is not a serious offence and that there is no wounded person.

You can however say to the judge something like: “then, further, I saw the police car following me!? It took me time to realize that he was pulling me over me because I never thought I have done something of wrong...

On the other hand, if the cop writes something ACCURATE in his report (read the section “Police report”) which is overpowering… you are done. Only you know it. For example, if you did not stop at a red light, and you even accelerated like CRAZY when you were still far from the light, that the cop precisely watching the light…. you are done!! Protesting is useless… or then consult a lawyer!

Advices given here are only if you are honest, and that you did not make the reproached infringement!

You wonder if the police officer who gave you the ticket will be in court? Few chances. But it happens. In the causes I assisted the Montreal court house, the police officer was never present.

Do not forget that the police officers have work to do… They must watch people who do not do their stop!!!

However, the presence in court of the police officer is very little important since you are not guilty, and you will prove it to the judge! It is the police officer's word against yours. If you say the truth, and you did notmake the reproached infraction, the judge will declare you not guilty!
