Ticket for unpaid registrations

Hello,

I was arrested on Thursday two weeks ago for speeding (129km/h on highway 40). I told to the officer that I only had a temporary paper licence without any photo and any other identity proof with photo since I noticed that all my identity papers were stolen (SAN card, hospital cards, driving licence, assurance card…) in my purse on our summer vacations. The Monday before my arrest I took a day off in order to have my licence reemit at the SAAQ, GVT, phoned to see if there was any risk that my identity could be stolen, phoned the police to do my deposition… However, I still had my registrations and car assurance paper since I don’t keep them in the same place in my purse.

The officer was far from comprehensive and took the paper that I got and came back telling me that there was going to be more than one ticket ! I didn’t understand what he meant. He told me that I was going to have two more tickets since my registrations that were due at the end of August (2 weeks before) was not signed and furthermore that WAS NOT PAID FOR !?!

I was convinced that I had paid for it in August with the other monthly payments, and I had my good registration in my purse (but not signed). I went at the SAAQ 3 days earlier and no one told me that my registrations were not paid !?
I told all of this to the officer and told me that it was weird that the SAAQ didn’t ask me to pay, and that unusually he should have towed my vehicle, but that he will only give me the ticket for registration not paid (14 days lateness) and that if I could prove that I paid I could void the ticket. I said OK since I was convinced that I paid my ticket and since I didn’t know that the ticket was worth 438$ !!! He let me sign my registration without giving me the 75$ ticket and let me go.

Finally to make a long story short, the SAAQ didn’t find my payment and didn’t retrace it either… Maybe the renewal notice was also stolen from my purse with my other identity cards…. ??

Back at the SAAQ to pay my bill, they tell me that it is not their responsibility to tell us that our payments are not up to date, even if we come after a rubbery or something else, Bla, bla, bla… but I still got a notice from the SAAQ about the fact that my payments were late, 2 days after I got my ticket !!!

I always been a person that is organized and on time for my payments, this, is only a following of unfortunate events (week full of s…) that cost me 563$ in tickets !!! Yes, I deserved that speeding ticket and I was very calm and polite all the time with the officer, but the 438$ ticket really got stuck in my troth.

My family tells my that I should contest the ticket for the registrations, but I am from Joliette, I have two young kids and I will have to take an other day off to go to Montreal (probably) to contest… and it is said that if we lose, there are 150$ in fees?

I don’t know what to do, what do you think ?

Indeed, you seam honest… but will it be enough in front of the judge? I am not sure… it is every driver responsibility to make sure that their licences are paid… It is not the obligation of the SAAQ to remember us…

The main path to explore for you is the fact that all your identity papers were stolen from your purse… but that didn’t stop you from doing the infraction… It could easily be won if you could find that missing payment…

Yes, Montreal seems far away… but you should know that it is possible to be heard on evenings… and yes indeed, there are fees if you lose your case… but you will win no?

You can also get a lawyer that can represent you in court…
