Ticket for passing on a red light



Sometimes, I have the impression that officers are blackmailing us… Read this story about Linda !

Hello,

I got a ticket from a Montreal City officer that is accusing me of driving on a red light (Highway 359) at a 60km/h speed in a 50km/h zone (3 demerit points). The officer arrested me two or three blocks further and at the moment the light turned yellow I didn’t see any officer around so I didn’t know exactly where he was standing.

I am 9 months pregnant (I was driving) and I was with my sister when I was arrested, the officer was alone. I think the light was yellow when I cross the line, so I would like to contest the 154$ ticket.

At the moment of the infraction, the officer ask for the assurance papers and I didn’t find it, I am assured it’s just that I couldn’t find the little paper… The officer told me that he was going the ticket saying that he saw the assurance papers, he said that I could got a 800$ ticket for that.

At the end, the officer tells me : YOU CAN ALWAYS CONTEST THE TICKET BUT IF YOU DO, I WILL BE OBLIGED TO SAY THAT YOU DIDN’T HAVE THE ASSURANCE PAPERS.

When I told him that I drove on the yellow light, he told me that the lights were synchronised and that I passed on the red light.

My question is : IS IT POSSIBLE TO BACK OFF AFTER CONTESTING A TICKET AND ASK FOR THE COMMUNICATION OF THE PROOF SINCE THE COMMUNICATION OF THE PROOF MAKES ME LOSE IN COURT. I PREFER TO STOP NOW AND PAY MY TICKET INSTEAD OF PAY FOR OTHER FEES IF I LOSE ???

IF I LOSE, HOW MUCH ARE THE FEES ??? THE TICKET IS 154$

First of all Linda, if you pass on the yellow light, you didn’t pass on the red light… So contest it ! This being said, when a green light has been green for a moment, drivers are supposed to slow down in order to put the brakes if they need to.

This being said, you must in the 30 days give your not guilty plead. Then you can ask for the communication of the proof. After that, you could change your mind and pay your ticket. But if you contest, you must know that sentences like “I think that” won’t give you a lot of chances… ;-)

You most be sure at 100%, that you passed or not on the red light !

Furthermore, your ticket is for a precise infraction. So the things that the officer says in court about other infractions don’t really have any impact on the judge verdict or on the ticket itself…. I wouldn’t worry about that.

Besides, it is not sure that the officer will be present…

About the court fees if you lose, indeed they can be quit substantial. Sometimes 69$, but sometimes it can be doubled…
