Ticket for amber light crossing

April 24th, 2011

Dear all,

Herewith I would like to join your blog. My story is below and I intent to contest the ticket. Any opinion or advice would be really helpful, if you could please post it on your blog.

What happened was that I was driving with 50 km/h in a 50 km/h zone on Sherbrooke East (Montreal) and I passed a yellow light. The police gave me a ticket which I will contest preparing to base my defence on C.C 24-2, Art. 360 of the Highway Safety Code of Quebec, where it says that “Unless otherwise directed by a sign or signal, when facing an amber light, the driver of a road vehicle or any person riding a bicycle must stop his vehicle before the pedestrian crosswalk or stop-line or, if none, before the near side of the roadway he is about to cross, unless he has entered it or is so close to it that he could not stop in safety; he may proceed only when a signal shows he may do so.” I believed I would not have been able to stop safely because of the speed and because it changed when I was very close to the stop line. Ticket for parking in a parking zone without a valid ticket

April 13th, 2011

Hi, I have received a ticket for parking in a parking zone without a valid ticket in Montreal

I parked in a zone on Prince Arthur I then fed the required amount into the parking meter and placed the ticket on the dash of my car. When I came back I noticed a parking fine on the window. The ticket says that I was parked in a metered zone without a valid ticket, I then noticed that I had entered the incorrect parking bay number into the machine (PB205 instead of PB204).

I paid the the required amount for a parking space and received a ticket, I couldn’t have parked in the other bay as it was allready taken and the same car was there when I left. This was a simple mistake, do I have a leg to stand on if I conteste this.

thanks

Dan

Cruise control on at a spot over 110km/hour

April 6th, 2011

I was going east bound on auto-route 10 around Bolton area. I was approaching an over pas on a decline with my cruise control on at a spot over 110km/hour.  I saw through the corner of my eye a car at the top of the ramp to the overpass, just the nose of the car. It looked as though it was stopped at the stop sign up there. As I come out from under the overpass I look in my mirror to see that it’s an SQ.

He clocked me at 149km I told him it was impossible because I had my cruise set.  (Albeit over the 100 km/hr allowance, but they usually don’t bother you at 110km. but, I didn’t tell him that) I never asked for proof of his radar.  That part of the road was in a decline; could it be possible that going down a hill with the cruise on, that it would have fluctuated that much (110 – 149)? My ticket is for 315$ and 5 demerits.

My question is; is there any way to fight it at least to a lesser fine or at least to remove the demerits.  One, the road was on a decline. And two, the SQ was hidden at the overpasses intersection at the top of the ramp.

Thank you,

Rob

Ticket because i did not hold onto my transfer

March 27th, 2011

I just got home on a Sunday night out with friends.  I had purchased 6 tickets from the metro vendor a few weeks ago.  When I got on at McGill station, I used a ticket, ran it through the machine, collected it and then discarded the ticket, since I live in walking distance from Jolicoeur station.

When I arrived at Jolicoeur, I received a ticket for $214 because I did not hold onto my transfer.  The transfer I believed I no longer needed, since I was not taking a bus afterwards.  The 4 STM “police” told me if I did not provide proof of identity I would be arrested on the spot.

They also told me they did not have to provide information about this “new policy” of having to hold onto transfers because it was on their website, and on the transfer itself.  But it was not a bilingual transfer, so being an Anglophone, I was unaware of this new
“law”.

Please advise me on the best way to contest this ticket, because I will leave the province before I pay one red cent of this illegal, immoral and unconstitutional ticket.

Parking ticket by mail

March 19th, 2011

Here’s an example of what kind of people are employed by Parking Montreal and what transpired today

I believe I was ticketed and will be sent a parking ticket by mail

I stopped at the entrance to the Marriot Chateau Champlain on Peel Street to pick up my wife at 5:00pm where she works. Turning into the driveway of the hotel I needed to stop  as there were several taxis and cars disembarking so I waited to pull in.

Where I waited for the cars to move there was a meter

Car 430-33 Ville de Montreal Parking Agent pulls in front of my car and blocks my forward progress into the Marriott and stares at me. I point to the entrance where I want to go but he’s in my way.
Now he flies out of his car and runs to the back of my car and starts to write up a ticket.  I said wait a minute I’m turning into the Marriott. Read the rest of this entry »

Speed changes from 60 to 80

March 13th, 2011

I have spent hours on hours try to find someone in my situation.

Here is my story :

I travel the same road every morning and afternoon to work and back. Now there is this one specific area that has a community safety zone in it. ( There are always cops there) Max Speed in this zone is 60Km/H. But there is a catch.

I was traveling south bound through this are one morning when I noticed a police officer about 1.5km ahead of me in an oncoming direction standing next to the side of the road with his emergency lights on.

My first reaction was “oh-craP” check your speed and yes I was doing my 60. A bit further on still inside the community safety zone the speed changes from 60 to 80.

Based on the fact that there was this police officer in his car with his emergency lights on, I was not sure what the problem was. I knew that I had to be able to pull off in a “SAFE” manner if it would be required and doing a emergency stop in a community safety zone does not fly with me. Read the rest of this entry »

No-Stopping zone Ticket

March 7th, 2011

The question of Julien that was stopped by a officer in a no-Stopping zone ! ! !

Is it a joke ??? No-Stopping zone Ticket because of that !!!

**********
About a month ago, on my way to school, i was pulled over because my exhaust was too loud. I got the ticket at 5:20. The officer who pulled me over was not in his car; he walked in front of my car and told me to stop on the side of the road, which was a No-Stopping zone. ( the officer was also parked in this zone, it is in front of a Tim Hortons). For the next ten minutes i was talking with the officer, asking him questions on why my exhaust was not legal. Today, i just received a ticket in the mail for “being stopped in a lane reserved that prohibits stopping” for 144$ with the time marked at 5:29. This ticket refers to the time when I was stopped for my exhaust about a month ago.  I was in fact in this No stopping zonee but the officer told me to pull over in the No-Stop zone. If an officer tells me to pull over in No-stop zone, i can’t be then given a ticket for being in a No stop zone?? Had the officer not pulled me over i would have never stopped in the No-stopping zone!

My opinion :

SURE !

Contest-it !

and ask right now for the Disclosure of evidence !

Maybe you will learn some stuff…

Ticket for overran the meter

March 5th, 2011

Little recurring question about double ticket risk…
This one is from giovanni

*****
I overran the meter & I got a ticket.
Can I leave my car on the spot without paying the meter or will they ticket me again?

*****

Answer :
Yup… it’s possible that if another policeman, or the same guy, after 24 hours, he give you a new one.
Don’t take chance and move to a safe place.

Ticket for running the red light on the T-section

February 28th, 2011

Hello,

Maybe you can advise me on the following :

On April 2nd 2010 I was handed a ticket for running the red light on the T-section of Sherbrooke West and Girouard. However, I still had a green flashing light when I entered the T-section, turning left into Girouard. At this point I had to slow down for a jaywalker who crossed Girouard. I assume that within that time the light turned red.

The police officer stood about 150 yards down (i.e. south) on Girouard. This street has a slight downhill slope. In my opinion the cop can’t have entirely witnessed the incident, but only saw my truck coming from the T-section after the lights had already changed.

Do I have any real chance in court to have that ticket dropped ? It’s the first time ever that I feel like I’ve been given a ticket for no reason. I got parking tickets here and there and always paid, but that’s about it.

Thanks for your help !
Al

The amount of the ticket changed

February 22nd, 2011

Sebastien story who wanted to contest a little fine seems to have grown with time… Indeed, the amount of the fine changed between the moment of the infraction and the appearance, the amount of the ticket changed !!
*******

Hello,
A simple little question,
I got a 37$ ticket and I plead not guilty. Yesterday, I got the appearance date, but the thing is that the ticket (if I want to pay in order to avoid going in court) is now 62$ Is this normal ? I wanted to see the communication of the proof before taking a decision…

Thank you

Sebastien

My opinion :

I don’t believe that this is possible… the amount on the ticket is the proof… If you pay know you will have to pay what is written on the ticket… If you go at court and you lose, you will have to pay the court fees also.
