Errors on the ticket



It is always frustrating to get arrested… so when we see an error on the ticket that the officer gives us, we are always ready to contest… but is it enough ?

Hello,

I received a ticket for driving 87km/h in a 50km/h zone and the exit of a village on road 132. Three (3) demerit points and 209$ to pay. However I noticed on the ticket (brief infraction report on the ticket) that there were 3 errors :

1- The color of the vehicle
2- The occupants (I was alone when it is written that we were two M/W circled)
3- Location of the interception: the location written on the ticket is at 1.2 km from the place that I was arrested.

On the report it is written that the operational beam strength is 100m. The officer was parked in front of the fire station at 900m perpendicularly from the interception location written on the report.

So my question is : Depending of those 3 errors named previously am I sure of winning my case ?

I am sure that I was not driving at that speed; furthermore, I remembered that a car drove by me at the entering of the village since I speed down when I saw the 50km/h roadsing a few meters ahead.

Many questioning facts here… on one hand, there are the errors on the ticket, and on the other hand, the doubts about the speed registered by the radar. Then, there is the possibility that the officer made a mistake about the car…

About the errors on the ticket and the speed registered by the radar, these are more technical contestations and that is not as easy as it was… you’d better get a specialized lawyer in this field.

However, if you are convinced (and not: I don’t think that), so the term: “I am convinced” is good, then you could go with that defence in front of the judge.

However, don’t forget to ask for the communication of the proof… the ticket that the officer gave you is only a small report… all the information will be written in the communication of the proof, that will include the real report of the officer.
