Ticket given to a bailiff

Thursday, December 30th, 2010

Hiiiiii, it is always better to pay our debts on time…
Is a city in right if she puts the tickets in the hands of a bailiff ?

********************

To whom it is destined,

I would like to know if the city of Montreal has the right to give tickets to a bailiff ?

If yes, they I need to pay the 404,31 amount (when it was given to the bailiff) and he charges me 10% of interest each month and now it will cost me more then 500$. I am 21 years old and I lost my drivers licence last march and I am just starting to work. My folks let me stay at their place in order to allow me to put my money away to pay my tickets which are over 1200$ plus this tickets to the bailiff. What should I do ?

I thank you for the information that you will give me please, shortly.

My opinion :

It seams normal that a bailiff tries, with legal ways, to get his money back… In the case of a city… I don’t know. I strongly recommend consulting with a lawyer and paying your debts and put away your car…

Bus destined to drive students

Thursday, December 30th, 2010

Near an intersection, you need to be very alert if school bus shows up her too… talk about this to Daniel… (an other Daniel… hahaha)

*******************
I just got a 274$ ticket and 9 demerit points by driving across a school bus. Will I need a lawyer to defend myself ? I already pleaded not guilty.

Thank you very much.

Here is some other information :

It occurred last week. I was in a T intersection, the police was in front of my and they turned on their right and me, I was going straight forward. I did my stop and when I entered in the intersection, the school bus got to the same intersection and put his yellow flashing lights and I continued straight forward. After about 100 meters the police pulled me over and told me that I didn’t my obligatory stop while passing by a school bus.

The results 274$ and 9 demerit points.

How to get rid of our car

Thursday, December 30th, 2010

Can the accumulation of non paid tickets reach us sooner or later ? Ask Fernande…

***************

My niece has a vehicle that is stored at a particular place. The vehicle doesn’t run anymore since an accident.

She says that she can’t give it anywhere or sell it since she has for 1500$ of unpaid tickets at the city of Montreal for forbidden parking. Is it true that she can get ride of the car since she can’t store it anymore and going at the junk ward will be too pricy.

What can she do ?

Ticket for a not conform muffler

Thursday, December 30th, 2010

Jonathan had something to be proud of with his new propriety! He quickly was back to reality when an officer gave him a ticket for a not conform muffler !!!

*******************

Hello,

I got a ticket for a car that I just bought 3 days ago… yesterday, I got a 174$ ticket for a not conform muffler.

But the thing is that the car comes with an original Volkswagen 20th anniversary sport muffler. The system in place is a complete neuspeed (in perfect condition) made expressively for this car with all the original features and it is not even noisy. A lot less than a Dodge SRT-4 or even than their police Charger (which have a modified muffler).

The problem is that I only have 5 days to change it. An other thing, this car is originally turbo compressed so I can’t only put in a standard system or my car won’t run right anymore. He entered a measuring tape and estimated that it was going to far… Ok, what are the standards for a GTI… What can he compare it to… every car is different even at the start everything depend on where is the muffler versus the back tip so check it out with a measuring tape don’t make any sense. And going by hear for the sound… wow! It is just like giving a ticket for speed using our eyes only. It doesn’t make any sense, I am truly frustrated. (more…)

Complaint for assault and battery

Thursday, December 30th, 2010

What a story this one !

I don’t know what do you think about this one folks… but I will not answer this one… Indeed, there is a complaint for assault and battery… so it is beyond my competencies !!!

Nathalie’s story :

The world is upside down…

My spouse was driving on the Décarie highway; a impatient man behind him was honking the horn without stopping and was following us closely, so my spouse decided to change of lane in order to avoid this stressing situation, as soon as he changed of lane, the other car followed ours and cut of right and hit the front of our bumper (the front fender on the passenger side up to the bumper)… (more…)

Road sign forbidding turning left

Thursday, December 30th, 2010

Little incomprehension here on the presence of a sign forcing to go forward in order for a private entry when further, there are no sign to forbid you to turn left on an other entry… why ?

Lolo’s story :
**************

I am on the Bridge Street, arriving on Montreal Island, getting out of Victoria’s bridge. A bit before the intersection Mill, the SUV that was preceding me stopped and put his left flasher on to turn in the Costco gas station on the other side of the street.
(45.486691,-73.550565)
Since I am stopped, I decided to follow the SUV in order to fill up my gas tank, since I am a Costco member.

An officer arrests us both.

There was a sign “obligation to go forward” from 3pm to 6pm barely visible behind the trees. It was 5:35pm.

There was also a sign “no U-turn allowed” that I saw clearly since it was red.

I ask the officer what should I have done in order to come and fill up my gas tank in a legal way.
He told me that I should have use the entry, much further (45.487073,-73.554545) and which is the entry of the Rogers building that has nothing to do with Costco. This is a near 650meters detour !!

I understand the use of the forbidden to turn left road sing on the public lanes, like when we drive up Papineau Street, it is forbidden to turn on Mont-Royal. This make sense.

But the interdiction to turn in order to get in a private entry (of a store), I believe that this is frustrating.
Why is this entry more dangerous then the other one a few hundreds meters away. Furthermore the gas pumps of the gas station were aligned in the direction of the entry I took !!!

Ticket because I didn’t respect a pedestrian crossing

Thursday, December 30th, 2010

This isn’t fun… Of course you would have stop if you saw it… Same thing for everybody…

Laurence story on the behalf on a pedestrian crossing :
************

Hello to all of you,
On May 11th, I got a ticket because I didn’t respect a pedestrian crossing when a pedestrian was engaged.

First of all, I never saw the pedestrian crossing since the line were completely vanished

Secondly, I never saw a pedestrian engaged, if that would have been the case, I would have stop, I am not a savage who runs over pedestrians in the street.

Question :
Can the vanished lines be a good way to talk about the ambiguity of the location where 3 police cars were parked to pull over people, which is a kind of trap if you ask me.

Secondly, can the officer prove out of any doubt that indeed their was a pedestrian engaged, with a picture. Since if it is only on our word, then it is his against mine…

Thank you and congratulations on your marvellous website that help us on many aspects.

Copy of a ticket by recommended letter

Thursday, December 30th, 2010

Sometimes, we discover a surprise in our mailbox… the kind of surprise that we don’t want to get !!! Ha ha ! Ask Ely about this !!!

When she never heard about this before…

She got the copy of a ticket by recommended letter

Her story :
*********************
Hello,

I am writing you to share with you my bizarre story. My spouse got a copy of a ticket from the City of Montreal court by recommend letter. The ticket said that the infraction occurred in February 2010. The copy was sent on April 24th at our biggest surprise, I remembered to my spouse the date that we were in the town center. It occurred that my husband let me down on the right side of McGill’s Avenue at the exit of the Montreal Trust Galerie. He got off quickly to go for a ride and came back at the same location to pick me up without putting the engine out. At the same time, an agent pass by us without saying anything… (more…)

Officer hiding to do radar

Thursday, December 30th, 2010

Alex caught a little ticket and asks a question that many of you are wondering… we can guess the answer but we wonder anyways… maybe if…

Is an officer hiding to do radar legal ?

His story :
***************

When the officers do radar, are they authorise to hide for example behind a safeguard and get out at the last minute to take the lecture ?

May 18th
*************
My opinion :

Of course they can… it is legal… and very lucrative !

But they do this for our safety of course…
