Thursday, April 29th, 2010

Here is, simply, the story of one of our reader, Lynda, who was able to win her case in court…
When we try… we can !

Thank you for the time you took to write your story and share it with us !

Hello,

Here is my story for the ticket I got for a stop.

Date: May 31st at 8:15 pm.
Location: Coaticook, “T” intersection on Major and St-Jacques Sud Street.

I was coming back from Sherbrooke, it was a Sunday night and it was a bit after 10pm.

On Major Street, in Coaticook, right before the stop at the “T” intersection on St-Jacques Street, I put on my right flashing light.

I do my stop, I look on my left, no one, I look on my right, I see the lights on a vehicle that was going from South to North, I look on my left again, still nothing.

I turn on my right and a bit further, an officer pulls me over asking me if I knew I he was arresting me: I tell him that I have no idea and he tells me that I didn’t do my stop.

I was very angry and told him that I indeed did my stop. He then informed me that I could contest the ticket and I told him that I would do it. (more…)

Ticket for failing to stop properly

Monday, March 29th, 2010

Ish… Sometimes, we are very careful, we are cautious, we look everywhere; there are so many things to look out for… Like for example, the kids near a school… Ron story…

**************

On December 3rd, I got a ticket for failing to stop properly. I am sure that I did my stop but I believe that the police officer wasn’t able to see it from his angle. The school where my son goes to just got dismissed and I was very carful in this area since some students where walking in the streets. The officer’s car was parked in the parking lot of a private house.

I took some pictures. Am I doing this right ?

My answer :

Indeed, you are on the right track. Don’t focus on the positioning of the officer. Focus on the fact you have being caught for… YOU DID your stop !

Ticket for not stopping at the stop sign

Thursday, February 18th, 2010

The story of Maria concerns many of us… She got a ticket for not stopping at the stop sign…

*****
Hi! I read some of the stories that you post here.

I would like to contest the ticket that I received today for not stopping at the stop sign but I am not sure if it is worth it to contest.

Here is the story:
I was going to pick up my son from school. I always take the same street everyday and plus the fact that the street is just next street to my place Carlton avenue corner Lavoie in Montreal. When I stopped in the corner I saw a man putting some wiper fluid in his van. I even noticed the container because it has a green funnel.

The hood was up. Then I noticed the police van at the back of the van (of course hiding). So I continue driving after I stopped, when I saw the police van following me. I thought he was just going somewhere else. Then he turned on his lights and I asked…

“What seems to be the problem sir?”

Police said: You did not stop at the stop sign.

I  said: I stopped sir, I even see you at the back of the van.

Police said: No, you did not stop you slow down. Can I have you driver’s license, registration and insurance paper.

I was so pissed off because If I slowed down, I wont be able to see him at the back of the van. I won’t noticed the man that putting a wiper fluid on his van with the hood of the van was up.
The truth is I was focused on what the man was doing that I did not noticed the color of the van.

I tried to go back on the same street to ask the man to be my witness..unfortunately, he was not there anymore nor the police van. tsk..tsk..

It was Feb 12 at 16:40 p.m., when the police stopped me and told me that I did not stop at the stop sign. He said that I was slowing down and not stopping.

I hope you could help me before I contest this ticket..

Thank you very much!

Parking near a stop sign

Wednesday, October 21st, 2009

It is not always easy to find a parking space, sometimes; we are tempted to park our car at the end of the lane, at the corner of the street. Bad luck… corners are bigger then we taught… Here is how Ginette got a ticket for parking near a stop…
*****

Hello,

On Friday the 19 of June 2009, I get back to my car after work. I park my car on a small street, on Logan Street at the corner of Tiffin, in Longueil. When I got back, I was chock to see a ticket stuck on my windshield. I get my camera out (I always have her with me), since I don’t understand why I got that ticket.

Then I read that I was parked at less then 5 meters from the stop sign. I am at 8-10 feet from the sign. There is no sign saying from here and on, it is prohibited to park your car (with an arrow). I am sure that with all the pictures I took from all sides, I am able to measure how far I was from the stop sign, but… do I stand a chance ? I believe that it is not very fair to give a ticket for this kind of infraction when it is not clearly marked.

Thank you for your answers, I think I want to contest. I drove for (?) 36 years and I never heard of this rule.

Infraction for a stop

Tuesday, September 22nd, 2009

Did Jessica do her stop or not… it is not clear in this story… however, the cop gave her an infraction for a stop… here is her story… which was even being filmed!
******

Hello, I, on March 27 at 9h06 am, was arrested by a police officer that told me that I didn’t stop my vehicle enough and filmed the infraction, but I believe that I am not guilty ! I saw the video and I put on the breaks for 2 sec looking at my right and my left, and then slowed down while my car was still going forward in order to make sure that nobody was there, or getting across the street ! I put on my flasher and looked again on the sides of the road! My father in law was there that morning, when I got arrested and we both asked ourselves why !

When the police officer talked to me he said, madam, I can show you the video if you want. I looked at it and I confirmed what I said. Furthermore, there is an audio recording where the police officer clearly says that I didn’t do anything dangerous! So if this wasn’t dangerous (not dangerous equals safe) why did I get this ticket ? My father in law also heard the police officer say that I didn’t do anything dangerous ! My father in law said that I was driving since he broke a bone in his back and to leave me a chance if I didn’t do anything dangerous ! (more…)

Ticket for not having completely stopped at a stopping sign !

Thursday, September 3rd, 2009

Did Johann was the victim of an overzealous police officer? He gave her a nice little “ticket for not having completely stopped at a stopping sign” Zealous or not zealous… hard to say… Be the judge!

Hello, so here, it is the first time that I’ve decided to contest a ticket given by a Montreal police officer. My story: (Situation: 3 stops crossroad… when I get to the stopping sign, I have the choice of going straight or turning left, since there is no street on the right). While I decelerate arriving at the stop in front of me I notice that the car ahead of me is stopped (the lady is flashing left) and the driver coming towards me is also stopped and allow her to turn in front of him.

Since she doesn’t get the message quickly, I have the time to get behind her and stop my car a few inches from the stopping line. I consider that since she had already passed the stop line when I arrived, and when I completely stop my car I was really only a few inches away from the line.

The lady in front of me finally turn and I slowly go forward without giving any gas, that’s when I realise that there is no one on my left, person that would had the priority, and so I pursue my journey. I only notice the police officer after I did my stop; he turned to follow me and allowed me to do the next stop to arrest me after. He told me that he wasn’t arresting me for this stop but for the one before this one… (more…)

Ticket for not making a proper stop

Sunday, August 30th, 2009

Spring time is a perfect time for this kind of infraction… In this case, it is not the actual infraction that is contest, but the information registered on the ticket… Stefi asked herself if the ticket for not making a proper stop can be contest since the color of the car that is registered and the address are not the good ones… the details :
****

I got a ticket last week at La Prairie, on Montreal south shore. I am accused of not making a proper stop. The police officer was “very” kind and I was very polite. When he gave me the ticket, he precisely said that I could always contest it! Once I was home, I read the ticket and I saw two errors. The address on the ticket and the color of the car was wrong. I am convinced that the police officer made those errors on purpose. What can I do to contest the ticket? Do I need to send a proof of my address? Must I send a photo of my car to prove the color? Or do I only need to make an “x” in the not guilty case and wait for the following events? It is still 154$ and 3 demerit points…

Can you help me?

Slipping at a stop sign ticket

Saturday, August 22nd, 2009

Pascal’s story probably happened too many of you… a dusty snow… a slippery street… and hop! We are not able to stop properly at the stop sign… crap! Here is his story as he told it…

Hello dear Sir King of the ticket contesting,
if you want to, I would like to propose you my story like many other did. You can probably help me out. By the way, nice job, I like what you are doing. I discovered your website while I was on Google.

So here is my story : Sunday afternoon, January 25th 2009, near 1pm, since a dusty snow felt down during the night, I got in my vehicle with my girlfriend in order to do some quick purchases. I get out of my ward as usual and drive towards the crossroad near by my home in order to turn on my right. When I came to stop my car at the stop sign, my car started to slip, my ABS breaks are working and so my car wants to go straight ahead. (more…)

Ticket in Laval

Tuesday, August 11th, 2009

Our stops at a stop sign are quickly done when summer quick in… we need to be careful since it could be dangerous… dangerous for the other drivers, the pedestrians and cyclists, but also for your wallet… here is a lesson Bobby learned when he got a ticket in Laval.

Ticket at a stop sign

Wednesday, July 29th, 2009

Getting a ticket at a stop sign is usual… but always frustrating…
Here is the story of Jamie…

****
Hi,

I just got a ticket for not immobilizing my vehicle at a stop sign. The cop had a laser gun and was hiding behind a hedge catching people and said I went through the stop sign at 20 km/hr. I don’t think I could have been going that fast, I tested it out afterwards and I don’t believe in a manual car that I could have only slowed down to 20…The cop did not show me proof of the speed I was going. I have never gotten a traffic ticket and never had an accident in the ten years I’ve had my license. I have however had some parking tickets. Is it worth contesting this in court or is it unbeatable because of the laser gun?

Thanks,

Jamie
