Speeding ticket contestation

Will they do a speeding ticket contestation ?

Hello,
My son got a speeding ticket in Rawdon. He was driving on a small road with a lot of curves (no houses on the side of the street) at the end of the village towards St-Ambroise. He was driving at about 70km/h since he taught he was in that zone. The officer was coming in the reverse lane and radar his speed. The officer said that he was driving at 91km/h in a 50km/h speed limit zone. My son is contesting and he is waiting for his hearing date. I would like to know the reliability of the radar inside of a moving vehicle.

14 demerit points fine

Sometimes we have good reason to contest a ticket… but in the case down below… what do you think ?

Pierre-Luc got a 14 demerit points ticket for quite excessive speeding…

His story :

This morning I got a 14 demerit points ticket for 170km/h in a 90km/h speed limit zone ok good, but the officer made an error about the amount of the fine it is 990$+255+10$ and it should be 1255$ but the officer wrote on the ticket 990$+255+10$ equals 1055$… what should I do, can I contest ???

Help me someone please, I kind lost it whit this dilemma, answer me quickly…

Ticket and probationary licence

Ouf ! When you have a probationary licence, you must be careful to don’t get any tickets since the numbers of points are limited…

I just got caught and got a 1195$ and 14 demerit point ticket (930+255+10) and I have my probationary licence… what should I do ? I will have my 15 points in August, but on my probationary I only have 1 point left (I lost 3points in last April) and I already am contesting 2 tickets (2 points 130 in a 100km/h zone) and (3 points, sure of winning) ? I just don’t want to lose the points.

Speed ticket while a car drove by me

While a car drove by… Jacques was caught by a radar by an officer and got a nice ticket ! Arght !

His question is often asked… can we contest a speed ticket while a car drove by me ?

His story :

My story is very simple : I was driving on the Lacordaire Boulevard (Côte) and I got arrested at 69km/h in a 50km/h zone. The problem is that a truck was driving pass by me. I ask the officer if it was possible that the registered speed was the speed of the other truck and he said that it is not very plausible and that it is very reliable !!! I didn’t believe that I was the one who was going to be radar, I so I didn’t look at my speed! What do you think ?

Excessive speeding and radar

Can we contest a ticket for excessive speeding without a radar ?

Here it is, I just got a ticket for speeding and I want to know if I can contest with the following facts. I ask the officer to see the proof of my speeding, and he didn’t gave me anything, he only gave me the ticket saying that I have 30 days to pay and I asked him two times.

Furthermore, on the ticket, he made a mistake on my first and second name even if it is well written on my driver’s licence. Last thing, the officer must write his name in clear letters, but it is impossible to read his name.

Can I contest this ticket since he made all those mistakes and he didn’t show me what I was asking for ?

Ticket because of a new roadsigns and markings

When we drive by the same place for many years and suddenly the roadsingns and marking are modify and becomes more restrictive, we can easily get caught… Can we say that we had good intentions ?

Here is Marc’s story that got a ticket because of a new roadsigns and marking.

Hello,

I got a ticket for big excessive speeding in a new marking zone. It’s right at the entry of the village, the zone goes from a 90km/h speed limit to a 50km/h speed limit. By the mid-June of 2009 (source verified with the ministry of transportation), the 50km/h zone was enlarge.

I rarely drive by in the area and on September 15 2009 I didn’t see the new roadsing. The officer arrested me and showed me the radar lecture of 92km/h. He told me that I was losing my licence right away for 7 days. I asked him more information and he told me that it was going to cost me 488$, 6 demerits points and that my fill will have this information for 10 years. So 10 years where, if I make an other big excessive speeding (40km/h over the speed limit) I will lose my license on the spot.

I work with my vehicle, so I tried and insisted on reducing the speed at 88km/h (speed that is not a big excessive speeding). The officer didn’t want to.

I wanted to plead not guilty and take an arrangement with the prosecutor for reduced sentence, but I just learned that this is not possible anymore. :(

I had my licence for 14 years and never got a ticket.

How could I reduce my sentence in court ?
And how much will it cost me if I win or lose in court ?

Speed ticket while passing by an other car

Hello !

I decided to contest a ticket I just got, at the same date, about a year ago. My hearing is in a few weeks. I am 27 years old and I’ve got my licence for more then 8 years and never got a ticket before that date; it is my first infraction.

The officer accused me of driving at a 70km/h speed in a 50km/h zone on the Laurentides Boulevard, in Laval. It is a basic 110$ ticket with the fees. I understand that usually people don’t contest “little” tickets, but most of the time I do it anyways.

I took this decision mostly because I wasn’t driving that fast and that I had to do an unusual manoeuvre and slightly speed up was the only safe move at that time. I was in the left lane on a 3 way road, traffic was intense and the road was diminishing to a 2 way. A car a speeding behind me (he should got the ticket !) and I analysed that it was dangerous to put the brakes, but the car on my right was also speeding up and the time I had to get in the center lane before the end of the third lane was pretty short. Speeding up was the only way for me to change lanes in a safe way, so I did it. A few moments after I passed by the car, I was the first car ahead and the officer registered my speed, without seeing the situation that I was in. (more…)

Speeding ticket without a visible road sign

When there are no road signs to indicate the speed limit or when we didn’t see it or when it was impossible to see it… if we get a speeding ticket without a visible road sign, can we contest ?

Hello,

I got arrested last week for excessive speeding, 53km/h in a 30 km/h zone. There was a park on my left, but no school. The officer gave me the following reason: you are near a bicycle path; the limit is 30km/h.

I had just got out of the garage where I put in some gas. When I got out, there was no visible sign about the speed limit allowed in that area.

Furthermore, I got arrested right beside a pretty 50km/h speed sign. When I asked the officer, he told me that limit was starting only after the traffic lights. That road sign is 100meters before the lights.

My question is: Was that 50km/h speed sign valid for the street ?

Thank you to add fact to help my defence. I believe I will contest my ticket.

Excessive speeding at 100 km/h

Hello,

I had a very… frustrating excessive speeding, Gatineau, on the Alumetière interchange. It is an infraction that occurred at the end of a highway limited at 100km/h right after the speed limit change. The speed registered is 79km/h.

The “bogging” thing and thing that push me towards contesting is :

  1. A part of the highway is minimum 60km/h and maximum 100km/h, and then drop at 50km/h so it is impossible ?
  2. The officer that registered my speed with his laser was in a curve right before I could see him, when I saw him he already dropped his laser, but the thing is that he was about 100meters away from the speed limit road sign, did he registered my speed before, in front or after the new speed limit?
  3. I had no difficulty to stop when I reached him, the thing is with the reaction time and the low distance, I am asking myself if I could have pass from 80 to 0km/h if I wasn’t already slowing down, mostly in a curve.
  4. In that zone, the speed limit was first at 70km/ and was recently diminished at 50km/h.
  5. I told the officer that right before the end of the speed limit, the vehicle that I drove by was speeding up, and so I slowed down after the usual time. He told me that it was plausible.

Are they extra fees if I lose in court ?
