Parking scooter Ticket

Wednesday, July 4th, 2012

I parked my scooter as I usually did right next to but outside of the little white L shape line that marks the edge of a city paid parking spot. This paid parking spot was the last one before the cross street intersection.
I got a ticket citing that I violated Article 386 par.4 of the highway safety code (c. C-24.2), having stopped a road vehicle at less than 5m from a pedestrian crosswalk without the necessity to do so.

I contested the ticket and my planned argument is that I could not have been within 5m of the crosswalk given that I was right next to a city parking spot, which couldn’t be within 5m of the walk without itself infringing on this code.

Do you think that is a valid argument?

Parking ticket for scooter

Friends go out together in Vieux Quebec… they have fun and stay put, they don’t do any trouble… at the same time other does ???

They came back to their scooter and what happens ???

A parking ticket for scooter !!! Grrrrrr… what to do ?

His story :

Last Sunday, me and two other friends decided to go and take a ride in Vieux-Quebec on our scooter. Downtown, parking places are pretty rare. After looking for a few moments we find one that is good. On our left, there were two road signs one over the other. The top one had an arrow showing a handicapped space on the left and the one on the bottom indicated 10 minutes parking Monday to Friday 8am-4pm. Since we were Sunday we parked right from the sign thinking we wouldn’t have any problems. When we returned, my buddy and me found a 144$ parking ticket (parked in an handicapped space). We didn’t understand right ahead we check out and it is true ! The front wheel of my scooter was a few centimetres (20 tops) on the left side of the sign. The officer really looked for tickets possibilities to fill his quota !

Can I contest since the biggest part of my vehicle was on the right side of the sign ?

Pictures on demand.

Thank you in advance. I am 17 years old and I don’t really have the money to pay this ticket !

Spring brings back those little two wheel vehicle… and I mentioned the scooters!

Sometimes a bit noisy (for others), does little wonders are very practical for youngsters, since they are affordable and not very costly to maintain… that’s why they are that popular.

However, kids are not sheltered from the police that watch tomorrow’s drivers… I imagine that getting a ticket for noisy scooter or not is pretty frustrating. But when you deserve it (stop, red light, etc.) you need to take it in… imagine in the following situation, how would you react…

Here is Mme Harvey’s story:

Good evening,
My son got a 128$ ticket for having a passenger on his scooter since he is only 15 years old.
I am going to tell you why I want to contest this ticket
Last May we offered our son a scooter.
My son wants to go and for a ride with his friend. But he is not sure about the law. (more…)
