Is an officer always on duty ?
If an officer shift end at 17h00… and he sees you jerking on the street at 17h02… can he give you a ticket ? Kevin’s question : An officer that is not on duty, can he give us a ticket ?

Ticket for refusing to stop on demand of an officer

We are always frustrated to get a ticket from an officer…mostly when we are a bit in a hurry…

But it is not really wise to avoid “concluding the transaction” with the officer and leave the location… Here is Mario’s story that got a ticket for refusing to stop on demand of an officer plus his first infraction…

On October 22nd 2009 and got two tickets (article 366 and 636) for refusing to stop on demand of an officer when I was arrested and I asked him why. He didn’t say anything…

So I ask him to take my plat number and to send me the ticket by mail.

I got a 2$ ticket (art: 366) and a 438$ (art: 636). The officer took his notebook and took my plate number like I told him. However, I haven’t expecting to get two tickets. The 366 is for not stopping my cat in front of the line on the street, when there wasn’t a sufficient space to avoid blocking the intersection.

The other, the 636 is for not stopping my vehicle when asked by an officer. I want to contest the 490$ ticket. First of all, I was waiting on the corner of Berri to turn left on towards the Jacques-Cartier Bridge on the René-Lévesque Boulevard.

The officer came out of nowhere in front of my vehicle when the Nissan Pathfinder stop quickly behind me. That is when I saw that the officer wanted me to pull over. I believe that he didn’t like the fact that I stopped my car in the middle of the lane instead of the side of the road. Furthermore when I left in front of his silence.

Some tell me to contest… your advice and opinion.

Sufficient motive to contest ?

Fan was caught in a 30km/h zone by an officer that was in a hurry to give the ticket… A small error in the name, no badge on and no conformed uniform… Is it a sufficient motive to contest ?

Here is mine: This morning, an officer arrested me for excessive speeding in a 30km/h zone. He had a fluorescent yellow shirt and no apparent badge on, he didn’t even introduce himself. Is this a sufficient motive to contest ??? Furthermore, on my ticket, there is an error in my name. An accent is missing and it is a computer made ticket. I must say that my name was all in capital letters.

Offence to occupy a space on the street

A nice surprise for mommy Nadia! Her boy comes back home with a ticket ! And not a ticket for speeding or doing a bad behaviour… but for the offence to occupy a space on the street !?! Go figure! Where can we put our kids ?

My 15 years old boy was playing with 3 of his friends, on the side of a street next to a public park, in our residential neighbourhood. A police officer warns them that they need to move since they are stopping the traffic. Two of them were on their bikes, one by foot and my son had a skateboard. The 4 boys get on the side of the street in order to keep chatting.

15 minutes later, the same officer came back and with a louder and angrier tone, gets mad by telling them that they can’t stay there.

My son told him that they were not doing any harm, so the officer gave him a ticket for offence to occupy a space on the street.

What is the law concerning that infraction ?

Radar results of a police man going in the other way

Hi,
I got this ticket for excessive speeding. The officer was coming towards me (not behind me, but in front of me!) How could he take a radar result of my speed, while driving himself at 90km/h speed in the reverse way ? Is this even legal ?

My answer :

Of course they can… The radars register the “global” speed and deduct the patrol car actual speed… It is built in… You don’t stand a chance at all!

Ticket not signed by the police officer

Melodie is part of the people that got a ticket not signed by the police officer… Is it enough to contest it ?

I got a hand by ticket from an officer that didn’t sign it. I only have his matriculation plate number and not even his name… Should he have sign the section where it is said “I attest having see the infraction… and all the information are true” ? Or is the simple matriculation plate number (electronically written) is enough to do the job ?

My opinion :

Indeed, there has to be a certain “certification” that an offence had occur and a simple matriculation plate number is not enough if we follow the code… But it is not won for that much… It is the same case the Maitre Hélène Lamoureux wants to defend in front of the Superior Court, since lets remember she lost her case in front of the judge in Montreal Municipal Court.

Excessive speeding, police officer without a radar and without judgment.

Hello, I was driving at 130km/h on the 138 road (90km/h speed zone). I was lost in between Baie-Comeau and all the little villages.

My job brings me to travel a lot and on long distances and on that day, I was getting back from a back and forth Quebec-Baie-Comeau trip.

I confess, I am guilty. However, the officer really made a bad impression on me.

He ask for my: “license and registration please”. He came back 5 minutes later saying “there you go, you have 30 days to pay, all the details are inside, bye”. Wow! This is it ? I ask him at what speed was I driving he says at 130km/h. I say ok, can you prove it with your radar registration ?

He says that he can’t and go back to sit in his vehicle. (more…)

Here is Denis little story who, while taking a new itinerary, near a crossroad, see a police officer making him signs, he listen and bang, a ticket !

You have very interesting explanations. Here is how I got my ticket. I was driving on the Metropolitan’s access road heading East near 5:00pm on a Thursday afternoon. I just turned right on St-Denis Sud. I was in the middle lane, I looked at the 1st lane to see if it was still reserved or if I could use it to turn on St-Denis. There wasn’t any painting on the road, so I taught that I missed the line indicating the end of the lane. But, I was still hesitating. There was a police officer on the first lane that was making signs meaning that I could change lane and go forward.

I taught to myself : “ Here is an officer that’s managing the traffic, that’s great, I will follow his directions ”. I changed lane just behind the car near the officer that refused to let him go forward. He was making signs to the car in front of me in order to make her turn in a parking lot. It was the same thing for me since I was following that car. Well, I receive a ticket since I drove 15 feet in a reserved lane not well marked and with a police officer that was making signs to change lanes ! (more…)
