Errors on the ticket

It is always frustrating to get arrested… so when we see an error on the ticket that the officer gives us, we are always ready to contest… but is it enough ?

Hello,

I received a ticket for driving 87km/h in a 50km/h zone and the exit of a village on road 132. Three (3) demerit points and 209$ to pay. However I noticed on the ticket (brief infraction report on the ticket) that there were 3 errors :

1- The color of the vehicle
2- The occupants (I was alone when it is written that we were two M/W circled)
3- Location of the interception: the location written on the ticket is at 1.2 km from the place that I was arrested.

On the report it is written that the operational beam strength is 100m. The officer was parked in front of the fire station at 900m perpendicularly from the interception location written on the report.

So my question is : Depending of those 3 errors named previously am I sure of winning my case ?

I am sure that I was not driving at that speed; furthermore, I remembered that a car drove by me at the entering of the village since I speed down when I saw the 50km/h roadsing a few meters ahead.

Sufficient motive to contest ?

Fan was caught in a 30km/h zone by an officer that was in a hurry to give the ticket… A small error in the name, no badge on and no conformed uniform… Is it a sufficient motive to contest ?

Thank you for you advices, according to your own ticket experience !!!
Here is mine: This morning, an officer arrested me for excessive speeding in a 30km/h zone. He had a fluorescent yellow shirt and no apparent badge on, he didn’t even introduce himself. Is this a sufficient motive to contest ??? Furthermore, on my ticket, there is an error in my name. An accent is missing and it is a computer made ticket. I must say that my name was all in capital letters.

Officer on an acces road

When the officer does radar speeding as he his getting on an access road… Can we contest it ?

The question is about an error in the name of the street… but is it the best defence ?

Hi, First, congratulation for your website !

Here is my story: I got caught at 148km/h in a 90km/h zone by radar.

I was on the highway and the officer caught me as he was getting on the access road to the highway. In the report, he wrote that he was driving from the Hamel Boulevard but that is not right, he was driving from the Charest highway. Can this play in my favour ? Thank you in advance !

Parking ticket in Montreal

It is always a big challenge to find a parking place in Montreal… And it is very frustrating to find a parking ticket on our windshield in Montreal… Can we contest an error written by the Police officer about the hour of interdiction ?

Hello,

I received a parking ticket, for leaving my car in the street, while parking was forbidden on Tuesdays from 12h30 to 13h30 in that street. The ticket says that the agent gave the ticket at 13h00

On the ticket, it is said that the parking was forbiddhen from 13h00 to 14h00.

So 2 things :
-    The ticket is not filled properly, since the hours were not the good ones (13h00-14h00, instead of 12h30 to 13h30)
-    By using the bad schedule, so from 13h00 to 14h00 can I contest, since the ticket was giving from the 1st minute of the forbidden parking (pleading that there was a small delay between the hour from my watch and the one from the City of Montreal)

According to you, can one of those two facts could help me void the ticket ?

It is only a 42$ ticket to pay, but I am a bit tired of not being able to park anywhere in Montreal. With the new bus lanes, the forbidding for the washing of the streets (not always done by the way), it has become daily struggle to own a car in Montreal.

Hummmmm, I don’t believe that you have a lot of chances… Because, even with the error made by the officer about the actual hours of forbidden parking… you did park in a prohibited place… and the procurer will ask you that question… this being said, for the question about THE minute… don’t forget that the officer say the infraction at 13h00, but you need to leave him the time to write the ticket… So if you had arrived in maybe 1 or 2 minutes, you would have seen him write the ticket…

It is up to you to see what you want to tell… in front of a judge… ;-)

I got a ticket for not stopping my vehicle at a red light (article 359 of the rules of the road) at the corner of Belfroy Avenue and Champchevrier Avenue in Anjoue (Montreal).

The thing is that there is no street light there, but there is a stop sign.

Is it fair to contest ?

Do I have any chance of winning or will I get a revised ticket if I win the first contestation?

Ticket to a minor…

Nicolas got a ticket… but what to do when the police give a Ticket to a minor…

His story :

i was coming back from school and i was going 54 in a 50 zone which then fell to a 30 zone and i didnt notice because i wasnt paying attention so i got a ticket… but on the ticket the police officer wrote the wrong license plate and also didnt check the box that says im a minor since im 17 even if he wrote my date of birth on the ticket… what should i do? does the ticket get void because of this? or should i tell them the mistake since i hear it takes a year to get the ticket back which would let me be extra careful for a couple month before i get my real license with 15 points allowed on it?

Error on the ticket

What are our options when there is an error on the ticket?

Hello,

I got a ticket for driving at 93km/h in a 70km/h zone and the police officer gave me 90$+ 25$fees + 10$contribution fine for a 125$ total. When I went on the SAAQ’s website, I notice that for this excessive speeding, the police officer should had gave me a 75$ fine instead of 90$.

Do I have any resort against this error? Would that cancel the ticket? This would be unfortunate!!! Hahaha!!!

Quoting from SAAQ website:

If the speed excess from 21 to 30 km/h the allowed limit then the fine is = 15$, plus 15$ for every 5 km/h exceeding.

In your case, it should be 75$ instead of 90$. You can contest the amount if you want and you will win, that’s for sure, but you still are guilty of the infraction… which is driving at a 93km/h speed in a 70km/h zone… it is up to you to see if the process is worth that 15$. In your case, the demerit points don’t change. However that is if you don’t contest the ticket? An error on the amount of the fine is not like an error on the driver or the vehicle. Nothing however is stopping you from getting in touch with a lawyer…

Name mistake on the ticket

Mathieu wife got unfortunately caught for an inattention error… However they noticed an name mistake on the ticket… is it enough to contest…

Hello, my wife was caught for turning left at a crossroad while it was prohibited between 7h00 and 9h00 (it was 8h30). She didn’t do it on purpose, she pass there sometimes, but never on the prohibited hours. Furthermore, she was following three other cars that all turned left. Unfortunately, the three others were in luck, we got arrested. I admit she did an infraction, but it wasn’t on purpose.

Is there a way to get out of this ?

Furthermore, when we inspected the ticket, I notice that her name was spelled wrong, she got a two word name and since there is a missing letter, this give an other name. Ex: Marie-Line instead of Marie-Aline.

Amount error on the ticket

A driver got a ticket for excessive speeding. Then, few days later, he got a letter saying that there was an amount error on the ticket given by the officer… Is this an opportunity to contest the ticket?

My 17 years old daughter got a ticket for excessive speeding on July the 3rd and today July 14th, she received a letter saying that the amount wasn’t exact, that it should have been 103$ instead of 110$ can I contest it ???

My daughter is a just starting to drive and she is allowed only 4 demerit points, this ticket gives her 2 points…Thank you very much for your instructive website…

My opinion :
I am not sure that an amount error can cancel the ticket… Maybe it can… Some anomalies can automatically cancel a ticket… You will need to consult a lawyer to be sure… It is not a big amount… it’s more for the demerit points and the consequences on the car insurance…
